The first Title of this doctoral dissertation presented to the Law Faculty of the University of Fribourg research focuses on the goals of antitrust laws, antitrust private actions, and the relationships between public and private enforcement of antitrust laws. The second Title offers a comprehensive review of several collective redress mechanisms in existence or proposed, such as the class action mechanism pursuant to Rule 23 of the U. S. Federal Rules of Civil Procedure. It compares Article 89 of the Federal Code of Civil Procedure to the American injunctive class action and discusses the Federal Council's July 2013 communication on group litigation. The Proposals would enable the public enforcer to work towards protecting consumers as well as the public at large, without the drawbacks or inefficiencies observed in certain jurisdictions.
