Comparative analysis on the Chinese contract Law

Autoren

Mehr zum Buch

The economic development of the PR China is speeding up in a tremendous way. Such development, however, is not always reflected in the PR China's legal system. Nevertheless, the 1999 Chinese Contract Law is a real corner stone of the Chinese legal reform. The present publication compiles detailed comparisons between the Chinese Contract Law and its counterpart provisions in the German Civil Code (Bürgerliches Gesetzbuch). The comparisons have been prepared by well-known international scholars, such as e. g. Wang Liming, Richard Buxbaum, Claus-Wilhelm Canaris and Gianmaria Ajani. All present legal comparative studies have been developed within the framework of the German Chinese Cooperation project „Advisory Service to the Reform of Commercial Laws at the Ministry of Foreign Trade and Economic Cooperation“. The project is supported by the Deutsche Gesellschaft für Technische Zusammenarbeit (GTZ) GmbH acting on behalf of the German Federal Ministry of Economic Cooperation and Development. The present book offers a helpful guideline, not only to Chinese and German legal practitioners and officials but also to scholars and students interested in comparative aspects of Chinese and German contract law.
