Together with the 6th Amendment to the Cosmetic Directive, it marked the first time that special efficacy claims could be legally made for cosmetic products, contingent upon providing evidence for these claims. This introduced a new independent "safety assessor," enhancing reliable marketing and ensuring transparency in proof, thereby protecting consumer health. Such claims necessitate high standards in scientifically based methodologies to substantiate them. The 6th Amendment also imposes strict restrictions on the use of conventional animal testing for cosmetic products and their ingredients, particularly for finished products. This creates a tension between the need to safeguard consumer health and the ethical considerations surrounding animal protection, as outlined in Council Directive 86/609 EEC. However, current knowledge indicates that human testing cannot entirely replace animal testing in all cases. Ethical concerns, along with a lack of understanding of the biological processes behind observed effects, often hinder suitable experimental methodologies, making it challenging to conduct human tests.
